These Terms of Service (“Terms”) are an agreement between you and Mokabyte LLC (“Mokabyte”, “we”, “us”) covering the Dagachii mobile app and this website (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to the Privacy Policy.
1. Who can use Dagachii
You must be at least 13 years old to use Dagachii — or older where your country sets a higher minimum age for using a service like this without parental consent (up to 16 in parts of the EU). If you're under the age where you can agree to terms like these on your own (18 in most places), a parent or guardian must agree on your behalf.
2. Your account
- Sign in with Apple, Google, or email. One person, one account.
- Your username is permanent— it's chosen at sign-up, doubles as your display name, and keeps friendships and challenge history honest. Pick one you like, and keep it respectful: usernames that are offensive, impersonating, or misleading may be reclaimed or removed.
- You're responsible for activity on your account. Tell us if you think someone else is using it.
- You can delete your account anytime in Settings → Privacy & Data. Deletion cannot be undone after it completes. If an external provider step is temporarily unavailable, Dagachii asks you to retry rather than claiming the deletion finished.
3. Fair play (the honest-miles rule)
Dagachii's challenges only work if every mile is real. You agree not to:
- fake movement — GPS spoofing, injecting fabricated workouts into Apple Health / Health Connect, strapping your phone to the dog, or any other creative fiction;
- exploit bugs, automate the app, or interfere with other people's challenges;
- probe, scrape, decompile or reverse-engineer the Service, or use it to build a competing dataset.
We may correct standings, remove ill-gotten rewards, or suspend accounts that break these rules. (Weekly point caps exist so grinding can't win either — see kind by design.)
4. Petals, Points & other virtual goodies
- Dagachii is free to download and play, with no ads or loot boxes. You may optionally buy consumable Petal packs through Apple's App Store on iPhone and Google Play on Android. Dagachii shows the Petal quantity and the store's localized price before you confirm each purchase.
- Petals may also be earned in the app. Petals can be used for eligible virtual items and can be converted into Points. Petals, Points, badges, avatars, themes, and yard décor are virtual items with no cash value. They cannot be sold, transferred, cashed out, or redeemed outside Dagachii.
- Petals, Points, and virtual items do not change recorded workout distance, pace, or duration and do not affect leaderboard standings or challenge results.
- Apple processes iPhone payments under its App Store terms, and Google Play processes Android payments. Refund eligibility and requests are handled under the applicable store's policies; contact us if a completed purchase was not credited. We may correct a balance for a refund, chargeback, duplicate credit, fraud, or technical error.
- We may change future catalog items, prices, or conversion rates as the game evolves. Your rights under applicable consumer law are not limited by these Terms.
5. Health & safety — please read this one
Dagachii is a game and a motivational tool. It is not a medical device and does not provide medical advice. Distance, pace, heart rate and calorie figures come from your device and health platform and may be inaccurate.
- Consult a physician before starting an exercise program, especially if you have a medical condition.
- Exercise at your own risk. Stay aware of traffic and your surroundings — never interact with the app while moving through an unsafe environment.
- Stop if something hurts. Kipy would want you to rest — rest days count anyway.
6. Being a good crewmate
Dagachii has no chat and no public feed, but usernames and group names are still seen by others. Keep them clean; don't use the Service to harass, impersonate or target anyone. Invite codes are for people you actually want in your crew.
We have zero tolerance for objectionable content and abusive users. Offensive, hateful, harassing, threatening, impersonating or spammy usernames and group names — and any abuse of other people — are not allowed, and objectionable names are filtered the moment you create them.
- Report anyone from their profile (the “⋯” menu → Report). We review reports and act on them — removing content and warning, suspending or banning accounts as needed — within 24 hours.
- Blockanyone from their profile to remove them from your experience entirely: you won't see each other in search, friends, or challenges. Manage blocks under Settings → Blocked users.
Accounts that post objectionable content or abuse others may be suspended or removed without notice. If something isn't right, tell us at support@dagachii.com — we act quickly.
User content and the license needed to operate Dagachii
“User Content” means usernames, group or challenge names, reports, feedback, and other content you submit through the Service. You keep any ownership rights you have in your User Content and are responsible for having the right to submit it.
You grant Mokabyte LLC a worldwide, non-exclusive, royalty-free license, with the right to sublicense to service providers, to host, store, reproduce, format, transmit, display, and moderate your User Content only as needed to operate, secure, and provide Dagachii. This operational license lasts while the content remains in the Service and for the limited time it persists in backups or must be retained for legal, safety, or dispute purposes. It does not give us ownership of your User Content.
Do not submit content that is unlawful; infringes another person's rights; contains private information you lack permission to share; or is hateful, sexually explicit, threatening, harassing, deceptive, or spam. We may filter, restrict, remove, or preserve User Content and related evidence where reasonably needed to enforce these Terms, protect people, investigate reports, or comply with law.
7. Our stuff & your feedback
The Service — including Kipy, the pixel cast, artwork, names, code and design — belongs to Mokabyte LLC and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable license to use the app for its intended, non-commercial purpose. If you send us feedback or ideas, you let us use them without obligation — and we genuinely read them.
8. Ending things
You can stop using Dagachii or delete your account at any time. We may suspend or terminate accounts that violate these Terms, harm other users, or put the Service at risk. We may also modify or discontinue features (or the Service itself) — if we ever shut down for good, we'll give reasonable notice inside the app.
9. Disclaimers & limits on liability
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied — including fitness for a particular purpose, accuracy of activity data, and uninterrupted availability. To the fullest extent permitted by law, Mokabyte LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, arising from your use of the Service. Our total liability for any claim is limited to the greater of $20 or the amount you paid us in the past twelve months. Some jurisdictions don't allow certain limits, so parts of this section may not apply to you.
10. Governing law & disputes
These Terms are governed by the laws of the United States and the state in which Mokabyte LLC is organized, without regard to conflict-of-law rules. Before filing any claim, contact us — most things are fixable with an email.
11. Changes to these Terms
If we make meaningful changes, we'll update the date at the top and give notice inside the app before the changes take effect. Using Dagachii after that means you accept the updated Terms.
